The Inter-American Court of Human Rights pronounced a condemnatory sentence against Brazil in the Márcia Barbosa de Souza case in 2021, when it recognized the negative impact of gender stereotypes in the scope of criminal proceedings. This article aims to analyze the case in question and present reflections on its importance for the construction of an Inter-American feminist jurisprudence, which uses the gender perspective as a decision-making and reparatory paradigm in human rights. It is concluded that this decision inaugurates the gender approach to Brazilian cases and provides important bases for advancing an Inter-American jurisprudential agenda concerned with the effective protection, in different social and legal instances, of women.
