On the legal nature of crimes against government and the rule of law

This article addresses the legal nature of the new crimes against government and the rule of law, brought to the Brazilian legal system by the Statute 14.197/2021. After going through the evolution of the idea of political crime, it tries to verify if there is space for this kind of crime in a democracy, concluding that political crimes do not occur in the Democratic State of Law, except to defend it, which is why the context in which the criminal offense occurs is important to establish its eventual political nature.
