The STJ precedent 231: critical analysis and perspectives for revision

The STJ Precedent 231, which states that "the incidence of mitigating circumstances cannot lead to the reduction of the sentence below the legal minimum," has sparked intense debate in Brazilian doctrine and jurisprudence, revived by Complaint to the STF nº. 80.625. This article analyzes the precedent and reaffirms the historical position of the Brazilian Institute of Criminal Sciences (IBCCRIM) for its alteration or cancellation of the precedent, in view of the constitutional principles of sentence individualization, legality and culpability.
