The punitive protection of women's rights

Critical criminology challenges the growing use of criminal law as the main instrument for protecting women. Although recent laws (such as the Maria da Penha Law, the femicide law, and other regulations from 2018–2019) represent symbolic advances, the criminal justice system has proven incapable of preventing new cases of violence, listening to victims, or transforming gender structures. Primary criminalization creates general criminal offenses, but its effective application depends on secondary criminalization by the police and the judiciary, with selective choices that disproportionately impact women, especially black women and those in vulnerable situations. Thus, affirming criminal protection and strengthening penalties can perpetuate the same oppressive punitive apparatus.
