This article examines the unconstitutionality of the progression thresholds introduced by Law 15,358/2026 (70% to 85% of the sentence in heinous crimes). It argues that these fractions effectively reintroduce the fully closed prison regime, previously declared unconstitutional by the Brazilian Supreme Federal Court in HC 82,959/SP. Combining normative analysis, case law, and empirical data from the National Council of Justice, the study shows that high thresholds, structural court delays, and expanded subjective barriers render the progressive system unworkable. Drawing on the “right to hope” doctrine, it concludes that the new thresholds violate human dignity, progressivity, and Brazil’s international obligations.
