This article critically analyzes Law 15,358/2026, focusing on the categories of ultraviolent criminal organization, paramilitary group, and private militia, and their violations of the principles of legality and offensiveness. The study seeks to demonstrate that a criminal policy based on endangerment crimes and open-ended sentencing guidelines disregards the role of those targeted by criminal law and opens the door to judicial arbitrariness.
