This article aims to promote a historical review of the criminal-political condition of japanese-brazilians during the Estado Novo (1937-1945). Instead of emphasizing the legal basis, it intends to verify how the punitive power was concretely exercised over its subjects and under which discourses of legitimation. During this period, the japanese-brazilians were expressly treated as "enemies" under the myths of "yellow danger" and "inferior race", with successive restrictions on fundamental rights, such as speaking publicly in japanese, to imprisonment and abuse that became part of their daily existence. We intend to draw from this some lessons about the proper characteristics of Criminal Law from the perspective of its concrete operationality, and not as an abstract structure.
