State precautionary punitivism as an exercise of power and control

This article deals with the power to punish the State as a form of social control, through the personal precautionary measures in criminal procedure. The research method used was the inductive, with the techniques of bibliographical research. It was verified the relationship of the jus puniendi (right to punish) state to determine the use of precautionary detention to the accused or processed, before a final conviction, as a form of exercise of power and control.
