Sentence of the IACHR in the case 12.315: Fernández Prieto & Tumbeiro VS. Argentina (01.09.2020). Court recognized that the arrests of Mr. Prieto & Mr. Tumbeiro were illegal and arbitrary. Absence of a court order, a situation of flagrante delicto and failure to prove, through objective criteria, the “suspicious attitude” alleged by police officers to justify the detention. Discriminatory police action. Violation of the rights to personal liberty, to privacy, to equal protection, to a fair trial and judicial protection. Interpretation of convention rights legally forces Brazilian State. Duty to strengthen the normative framework for “founded suspicion” to prevent racial profilling.
