The text has the objective of critically analyzing the plea-bargaining’s practices, more specifically the issues regarding the lack of criteria and regulations when offering a deal, as well as the social impact of the negotiations in a democratic society. The North American justice system will be used as reference, since it has served as an inspiration to the Brazilian Project. The research is justified once criminal negotiation seems to be an unstoppable tendency in the Brazilian system.
