Judge recusation by cognitive contamination on ongoing criminal cases: an analysis of Article 3-D of the brazilian code of criminal procedure

The study assesses the ways of applying the new cause of judge recusation introduced by article 3-D of the Brazilian Code of Criminal Procedure, here called “cognitive contamination”, to ongoing prosecutions before the implementation of the “anti-crime” law 13.964 /2019, analyzing, by the rules of intertemporal law, its incidence in concrete cases, its retroactive capacity in benefit of the accused, and what are the consequences of non-compliance of this newly introduced form of recusation of the criminal judge. The research concludes that the new legislation can affect ongoing cases in three different ways and warns of the risk of nullification of the prosecution when non-complied, leaving it necessary to establish which of these forms will be applied to the current cases.
