On the possibility of subsumption of “upskirting”, and similar practices, to the crime of sexual harassment (Art. 215-A of the Penal Code)

Both “upskirting” and similar practices are characterized by the production of unauthorized images of someone’s private parts covered or not by underwear. While in upskiting as such, the images produced have the victim’s private parts as their focal point, the same cannot be said about practices “similar” to upskirting. This article examines the possibility of conceiving these two types of production of unauthorized images as a “sexual act” to the purpose of the application of the crime of sexual harassment (art. 215-A of the Penal Code).
