The great challenge brought about by the apparently uncontrollable proliferation of hate speech and fake news in the virtual environment is to find appropriate solutions to the instantaneousness of the digital age, and not mere transpositions of law enforcement techniques that originate in the analog paradigm. Based on the notion of reconstructive criticism as a methodological basis, the work intends to analyze the German experience with regard to the regulation and control of fake news and answer the following guiding questions: What are the measures adopted by Germany to deal with the dissemination of fake news on the internet and to what extent can such a model serve as an inspiration for the debate on the criminalization of fake news in Brazil?
