The “death penalty” in the post-colonial state: the prision system from the optics of necropolitics and social injustice

It can be argued that the death penalty, although expressly prohibited by the Brazilian legal system, occurs through the prison system. Due to its unique characteristic, this article presents it as the “assumed death penalty”. The possibility of its occurrence is linked to the logic of necropolitics, colonialism and social injustice that mark the country´s society and history.
