The relevance of the Guarantees Judge to defensive investigation in the preliminary phase

With the advent of Law 13.964 / 2019, the Anticrime Package, this writing seeks to tense the importance of the guarantees judge for a better understanding and development of the Defensive Investigation institute in Brazil. Based on comparative analysis of procedural systems recently reformed in Latin America that adopted a posture of global change of their political-criminal orientation, from a predominantly inquisitorial system to another predominantly accusatory, we find the decentralization of the investigative powers of the hands of the State and its redistribution in the hands of the parties. In this context, the guarantees authority stands out as a control organ for this important activity that, in a Democratic State of Law, should not be consolidated exclusively in public entities.
