Microracism in criminal law:
contribution to the critique of legal-punitive subjectivity

This paper aims at the critical and materialist application, through bibliographical analysis of the concept of “microracism” to the scope of the criminal justice system, in its different processes of criminalization. At first, the structural function of reproduction of the capitalist mode of production that criminal law assumes will be approached. Next, the function of ideology as a supplement to the repressive state structure in the maintenance and even the advance of the capitalist enterprise will be discussed. As a result of the research, the concept of microracism will be understood as an ideological product that, in specific moments and places in the history of global capitalism, was produced as a necessary form of subjectivity for class-racial domination and colonialism, marks of the constitution of Brazilian society.
