Post-Functionalism in Criminal Law

The article examines how modern criminal theory remains anchored in dogmatic structures that link crime to the political function of punishment, reinforcing the centrality of state power. It argues that functionalism, by prioritizing penal purposes, narrows the understanding of crime as a broader social and political phenomenon. Post-functionalism is proposed as an alternative that restores the symbolic and denunciatory force of crime Bayon punishment, emphasizing the political meaning embedded in its very naming.
