Is it still necessary to discuss statement 231 of the Superior Court of Justice Precedent?

This paper is a criticism on statement 231 of Superior Tribunal de Justiça precedents based on the operationalization of the sentence time calculation formulated by Nelson Hungria, adopted by Penal Code, and the criminal legality, especially from the prohibition of contra legem interpretation perspective. Considering that judicial determination of the criminal penalty is an act of legally bounded discretion, it is proposed the possibility of reduction of the penalty below the legal minimum in the second phase of the sentence time calculation, in order to respect the sentence individualization, a constitutional principle.
