The presumption of innocence in the jury trial

On September 12, the Brazilian Supreme Court ruled that the sovereignty of jury verdicts justifies the immediate execution of sentences. This understanding was established by a majority vote in the judgment of Extraordinary Appeal No. 1235340 (Theme 1068), in which the Brazilian Institute of Criminal Sciences intervened as amicus curiae. The panel followed the position of the reporting judge, Luís Roberto Barroso, to give a “conforming interpretation” to Article 492 of the Code of Criminal Procedure, which restricted the immediate execution of the sentence to cases in which the defendant was sentenced to 15 years or more. This provision was considered unconstitutional for violating the sovereignty of verdicts. The dissent was opened by Justice Gilmar Mendes who, in the same vein as Justice Rosa Weber and Ricardo Lewandowski, both retired, defended the impossibility of immediately ordering imprisonment in the event of conviction, without having demonstrated the precautionary need for the measure.
