Abstract

A man standing beside a car on a public road could be just what these words describe, as long as this man was not a black man. Francisco Cicero dos Santos Júnior is proof of this. Approached by the police during a routine patrol, he was spotted and described as "a black individual who was at a typical drug dealing scene. No other characteristics were used to describe Francisco, because the black epidermis is the trigger that drives and legitimizes the repressive state apparatus. Thus, he was led and arrested, to be later indicted and convicted for drug trafficking. In general terms, this is the background of the trial that began on March 1 of this year, before the Federal Supreme Court, due to the filing of HC 208.240 by the São Paulo Public Defender's Office.
