Need to revise TJRJ Precedent 70 to guarantee the presumption of innocence

IBCCRIM was admitted as an amicus curiae in proceeding No. 0032357-91.2024.8.19.0000, initiated at the request of the Public Defender's Office of that state, regarding the cancellation or revision of Precedent 70 of that court, which states: "the fact that oral evidence is restricted to statements by police authorities and their agents does not disallow conviction." For the Institute, the constitutional guarantee of the presumption of innocence "can have its effectiveness inhibited by interpretations of Precedent 70 that end up overvaluing police testimony, even if in a residual way". In addition, it is argued that "a culture of respect for fundamental guarantees and creating incentives for police testimony to be corroborated by external elements, when possible, tends to improve the quality of investigations, as well as curbing instances of police abuse".
