Abstract

This article examines the conceptual and legal boundaries between organized crime and terrorism, based on frameworks from criminology and Brazilian law. It argues that these categories differ in motivation, structure, and purpose, requiring specific and distinct state responses. The paper analyzes domestic and international legal instruments governing each phenomenon and identifies the risks associated with an improper expansion of the terrorism label to include criminal organizations. Finally, it discusses the potential impact of unilateral classifications on national sovereignty, international legal cooperation, and the consistency of public security policies.
