Abstract

The new Abuse of Authority Law (Law 13.869/2019) reignites the debate on the limits of state power, the accusatory system, and the democratization of justice. Although it represents progress compared to the 1965 law, its effectiveness is limited by criminal selectivity and institutional resistance. The text criticizes the elitism of the judiciary, the lack of representativeness and transparency, and advocates for more profound structural reforms, such as external control and democratization of legal careers. The isolated criminalization of abuses, although symbolic, reveals the urgency of confronting authoritarian practices and the democratic deficit in the Brazilian justice system.
