Abstract

In December 2023, the Office of the Prosecutor General filed ADO No. 84 in the Supreme Federal Court, which was later converted into ADPF No. 1,143, alleging a partial omission by the National Congress in ensuring the constitutional rights to privacy, private life, and confidentiality of communications (Art. 5, X and XII). The situation is as concerning as it is paradoxical: the institution responsible for safeguarding fundamental rights proposes to restrict these rights under the pretext of protecting them.
