Abstract

Forty years after the enactment of Law 6.863/79, it is clear that its amnesty was partial and restricted—granting pardon only to part of the opposition—but in 2010, the STF extended its effects to torturers, constituting a self-amnesty that violates international human rights obligations. The Inter-American Court condemned the Brazilian State for failing to investigate the disappearances. Even so, the amnesty was decisive in restoring political freedoms and reorganizing the party system, although it remains a symbolic sign of the incomplete democratic transition.
